Terms and conditions
These terms reflect the rules stated across the site. They have not been reviewed by a lawyer: professional validation is recommended before relying on them against a customer.
Purpose and scope
These terms govern the day trips at sea offered by New Life Catamaran departing from Marina Fort Louis in Marigot (Saint-Martin). Making a booking means accepting these terms. No sale and no payment is made directly on this website.
Services and capacity
Trips are exclusively private day charters, with no night on board. The boat carries six guests maximum. Sailing is handled by a professional skipper: bareboat charter is never offered.
Rates
Rates are quoted in euros and cover private use of the whole boat, for up to six people. They vary neither by season nor by the number of guests. Any sailing hour beyond the charter's stated timing is charged at €175. Lunch is not included; champagne is available as an extra, at €70 per bottle.
Booking and deposit
Booking is made by email or WhatsApp. A quote and these terms are sent to you. A 30% deposit confirms the booking and secures the dates; the balance is settled no later than thirty days before the date of the trip.
Cancellation by the customer
Customers may cancel at any time before the trip begins, by informing New Life Catamaran by email at eric@newlifecatamaran.com. The date the request is received determines the charges due. Standard cancellation charges are as follows: up to thirty days before the date of departure, 25% of the total booking price including tax; from twenty-nine days before departure until the date of departure, 100% of the total booking price including tax. Failure to show up at departure is treated as a cancellation on the day of departure. Taking out cancellation insurance is strongly recommended.
Exceptional circumstances
If exceptional and unavoidable circumstances arising in Saint-Martin or its immediate vicinity prevent the trip from going ahead or prevent guests from reaching the point of departure, the booking is cancelled free of charge and all sums paid are refunded in full, with no further compensation.
Changing or transferring a booking
A request to move a booking to another date is considered case by case, subject to the boat's availability; it is not a right and does not suspend the cancellation scale above until a new date has been confirmed in writing. Customers may, however, transfer their booking to another person meeting the same conditions, giving written notice no later than seven days before the trip. The transferor and the transferee are jointly liable for the balance of the price and for any costs actually incurred by the transfer.
Changes made by New Life Catamaran
New Life Catamaran may make minor changes to the service — details of the route, order of the anchorages, incidental comfort equipment — and will inform the customer. Should an essential feature of the trip have to change, the customer is informed without delay and may either accept the proposed change or cancel free of charge and obtain a full refund of all sums paid within fourteen days.
Weather conditions
The decision to sail rests with the skipper, sole judge of safety, and is taken on the morning itself. If conditions do not allow safe sailing, the trip is moved to another date during your stay or refunded in full, deposit included.
Right of withdrawal
Under article L221-28 12° of the French Consumer Code, leisure services supplied on a specific date are not subject to the fourteen-day right of withdrawal. The cancellation terms above apply instead.
Liability, safety and insurance
Guests are covered by the vessel's insurance. The skipper's instructions must be followed at all times. New Life Catamaran accepts no liability for damage resulting from failure to follow those instructions, nor for the loss or theft of personal belongings on board.
Consumer mediation body
Under article L612-1 of the French Consumer Code, consumers may refer a dispute free of charge to a consumer mediator, after a written complaint to New Life Catamaran has gone without a satisfactory answer, and within one year of that complaint. Governing law
These terms are governed by French law. Any dispute falls to the competent courts, after an attempt at amicable resolution.
